The Ninth Circuit Court of Appeals yesterday ordered the US government to repeal the Don’t Ask Don’t Tell act, which prevents gay soldiers serving in the military.
The act was annulled by President Obama last year, but could not take effect until the military leadership and president had proven that its repeal would not affect the efficacy or readiness of the military.A three-court panel ruled: “The circumstances and balance of hardships have changed, and [the government] can no longer satisfy the demanding standard for issuance of a stay.”
